Cancellation Policy


In the event the client or photographer decide to cancel the session, communication must be made prior to the session taking place. Cancellation will require at least 48hrs notice to receive a full refund minus processing fees. Either party can cancel without reason up to 24hrs in advance as long as clear communication has been made. (May not receive a refund potentially if 48hrs in not provided)


Rescheduling


In the event the client and/or photographer decide the services cannot be completed on the originally scheduled day, time or site, options will be considered and discussed by both parties. If this is a result of weather, an indoor location may be offered to accommodate if appropriate. (I do not have a studio so this may not apply always). In this case, no refund will be provided since the service will be completed in the foreseen future.

Unforeseen Emergency


In the event of an emergency: Family, Medical, Car, Home, Pet or other takes place after the 24hr window, communication must be made between photographer and client to provide arrangements for completion of services. If an arrangement cannot be made, the deposit may be withheld to recover any losses. Under certain circumstances funds will be refunded. However, some circumstances funds will be kept.


Contract Details


Upon scheduling a session you agree to and understand you are committing to all contract details stated on this site, Kaye's Kandids social media, details discussed in messages, over the phone or face to face. This is to prevent any harm to client and photographer. All images belong to and are the property of Kaye's Kandids and the photographer providing the service. Should you edit or otherwise use the images without approval from the photographer, you may be subject to legal action.


Behavior Contract


All parties agree to conduct themselves in a professional manner.

This includes resolution of any conflict.


Should either party disrespect, demean, undermine, behave poorly, harass or become abusive in any manner, the contract will be immediately voided and no refund will be provided.


Void of Contract


Should the services agreed upon not be provided within the 30 day time frame, the client will be offered a partial refund with product available at that time, discount on future session OR full refund with no requirement of product delivery. This includes damage to equipment, camera, or computer leading to loss of photographs. Contract may also be voided should there be any unauthorized use of images, unauthorized photographing during the session or editing of the photos without permission.

Release of Liability


All photoshoot Clients MUST agree to the following:


Release is understood upon scheduling that, should the client choose photos that may injure or otherwise harm the client or photographer in any way, this is solely the responsibility of the client. The liability will be placed solely on the client requesting the services that could potentially harm any involved. This includes but is not limited to the use of fire, weapons, sports that involve potential injury, live animals or any other activity or location that could potentially harm any involved. Appropriate safety measure fall solely on the client. Kaye's Kandids bears no responsibility for any copyright infringements. It is solely the client's obligation to secure all necessary permissions for the use of any props, people or locations owned and operated by third parties not under contract with Kaye's Kandids.


Understand that by scheduling, this is acknowledgement that you've read these terms, asked all questions prior to scheduling and agree to all of these terms.
